What’s New with ACA?
The Affordable Care Act is no longer new, but what’s new with ACA? Updated versions of the 1092-C and 1095-C for 2016 and have been released, and the IRS has issues an updated rule for employers offering self-insured health plans about how and when to solicit SSNs for those individuals enrolled in their offered plan.
New Forms 1094-C and 1095-C
In July, the IRS released proposed draft versions of 2016 Forms 1094-C and 1095-C forms, and in August they released the proposed instructions. Below are some of the more obvious changes to the forms.
- 1094-C: The 1094-C has very few changes. Line 22 of the form, which displays Certifications of Eligibility, no longer offers an option for B – Qualifying Offer Transition Relief. Checking the box for option B was only available in 2015, so the IRS has changed the verbiage on the 2016 form to read “Reserved”. If your company used B on the form for 2015, you should consider changing that value for 2016 as that option is no longer valid.
- 1095-C: You may recall that Line 14 of the 1095-C is used to indicate the offer of coverage made to the employee. With the 2016 form updates, there are two new codes available that reflect conditional offers of coverage to the spouse. A conditional offer of spousal coverage means that the offer of coverage is subject to an objective condition, for example, an offer to cover an employee’s spouse only if the spouse is not eligible for coverage under their employer.
